Scope of Application

These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to all products and services offered by Schaffner Investment Properties AG (SIPAG) (hereinafter referred to as “SIPAG”), as well as to the use of the websites and platforms operated by SIPAG.
The GTC apply to all legal transactions concluded by SIPAG and to all legal relationships between SIPAG and users of its websites and platforms (hereinafter referred to as “Clients”). SIPAG reserves the right to amend these GTC at any time and without prior notice.

Non-Binding Information

The information published on the websites and platforms operated by SIPAG does not constitute an invitation to submit an offer and does not represent an offer or recommendation to purchase or sell, finance or insure real estate, or to enter into any other transaction.

Client Obligations

The Client is obliged to provide SIPAG with all information and documentation required for the provision of services. SIPAG is under no obligation to verify such information for accuracy, completeness, or consistency.

Prices and Payment Terms

All prices are stated in Swiss Francs (CHF). SIPAG reserves the right to change prices at any time. The price valid at the time of contract conclusion shall apply to the Client.
Invoices are payable without deduction within 30 days from the invoice date (“Due Date”). The Client is not entitled to offset its own claims against SIPAG’s claims, nor to withhold or reduce payments.
If the Client fails to meet the agreed payment deadlines, interest of 5% per annum shall be payable on the outstanding amount from the Due Date without reminder. SIPAG reserves the right to claim compensation for further damages.

Warranty and Liability

Statutory warranty claims (in particular rescission and price reduction) are excluded.
SIPAG shall only be liable for direct damages caused by gross negligence or wilful misconduct and which fall within its area of responsibility. SIPAG shall not be liable in any event for indirect or consequential damages, loss of profit, incorrect transmission, or loss of data. To the extent permitted by law, all liability is expressly excluded.

Data Protection

By accepting these GTC, the Client acknowledges and expressly agrees to the data protection policy of SIPAG.

Copyright

The content and works created by the site operator on these pages are subject to copyright law. Reproduction, editing, distribution, and any form of exploitation beyond the limits of copyright law require the prior written consent of the respective author or SIPAG. Downloads and copies of this site are permitted for private, non-commercial use only.

Final Provisions

All legal transactions with SIPAG are governed exclusively by substantive Swiss law, excluding international treaties and conflict-of-law rules.
The exclusive place of jurisdiction is Erlenbach ZH, Switzerland, unless mandatory statutory provisions provide otherwise.

Severability Clause and Validity of the GTC

Should any provision of these GTC be or become invalid for any reason, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the relevant statutory provision. Oral agreements shall only be valid if confirmed in writing.
